General Terms and Conditions
Definitions
In these general terms and conditions, the following terms shall have the meanings set out below, unless the context indicates otherwise:
Pure Media: the user of these general terms and conditions.
User: any natural person not acting in the course of a profession or business, who has entered into or intends to enter into an agreement with Pure Media.
Parties: Pure Media and the User jointly.
Agreement: any agreement concluded between Pure Media and the User, including but not limited to:
- the agreement for the use of the website through registration;
- the agreement for the purchase of credits to access certain website functionalities.
The Agreement also includes all provisions declared applicable to the legal relationship between the User and Pure Media, including these general terms and conditions.
Website: the website operated by Pure Media where Users can register and enter into agreements.
User Area: the section of the website accessible exclusively to the User via username and password.
Content: all data uploaded, published, or distributed by the User via the User Area, including but not limited to text and images.
General Provisions
These general terms and conditions apply to every offer made by Pure Media and every Agreement concluded with a User.
The terms are made available to the User prior to registration in such a way that they can be stored on a durable data carrier.
Failure by Pure Media to enforce strict compliance with these terms does not imply waiver of any rights.
If any provision is deemed invalid or void, the remaining provisions shall remain in full force. The Parties will replace the invalid provision with one that reflects the original intent as closely as possible.
Provisions that by their nature are intended to survive termination shall remain applicable after termination.
Fictional Profiles ("Flirtz")
The User acknowledges that Pure Media uses fictional profiles ("Flirtz") for entertainment purposes. These profiles are not real members and are operated by the platform. Pure Media does not guarantee any specific results from the use of the Website.
These profiles may engage in fictional conversations, roleplay, or other simulated interactions for entertainment purposes and to stimulate engagement.
All content originating from such profiles is fictional. Any resemblance to real persons is purely coincidental. It is not possible to arrange real-life meetings with these profiles.
Flirtz profiles can be identified by a chat icon displayed on the profile picture.
Offers and Registration
The User cannot derive rights from offers containing obvious errors.
Registration is required to use the Website. The Website may contain explicit content and is strictly intended for users aged 18 or older. By registering, the User confirms they meet this requirement. The Website is strictly intended for adults aged 18 years or older.
The User may not register under another person’s identity and indemnifies Pure Media against claims arising from such misuse.
The Agreement is concluded once registration is confirmed and the account is verified.
The User guarantees that all provided information is accurate and up to date.
Only one account per User is allowed. Free credits are limited per account and IP address.
Pure Media reserves the right to revoke usernames.
Use of the Website
Use of the Website is entirely at the User’s own risk. Pure Media does not guarantee uninterrupted or error-free service.
Users must be aware that:
- other users may not be who they claim to be;
- interactions may involve misleading or unlawful behavior.
The User is responsible for all interactions and content.
It is prohibited to:
- upload unlawful, harmful, or discriminatory content;
- share personal contact details publicly;
- engage in illegal activities;
- harass, threaten, or intimidate others;
- distribute spam or misleading content;
- upload content involving minors, animals, or third parties without consent;
- promote external services or websites;
- interfere with the operation of the Website.
The User is responsible for safeguarding login credentials.
Pure Media may remove or modify content that violates these terms but is not obligated to monitor all content.
Users guarantee they have the rights to any content they upload.
Escort services or paid sexual services are strictly prohibited.
Refusal, Blocking, and Removal
Pure Media may refuse, block, or remove accounts without providing reasons, especially if:
- the User violates these terms;
- the content is unlawful or inappropriate;
- the profile contains harmful, offensive, or illegal material.
No refunds will be issued if an account is removed due to violations.
Termination
Users may delete their account at any time.
Unused credits are non-refundable upon voluntary termination.
Pure Media may terminate services at any time. Refunds may apply only if termination is not attributable to the User.
After termination:
- all User content may be deleted;
- no storage obligation remains;
- all rights granted to the User expire immediately.
Credits, Payments, and Withdrawal
Credits are required for messaging and other features.
Prices are displayed on the Website and include applicable taxes.
Users have a 30-day right of withdrawal unless credits have already been used.
Refunds are processed within 14 days via the original payment method.
Credits are non-transferable and cannot be exchanged for money.
Pure Media may change pricing at any time.
Storage of Payment Data
Users may choose to store payment details for convenience.
Stored data is used only for user-initiated transactions and not for recurring payments.
Users can update or delete payment details at any time.
Liability
Pure Media is not liable for:
- User interactions or behavior;
- failure to meet expectations;
- damages resulting from Website use;
- unauthorized access to accounts;
- downtime or technical issues.
The Website is provided “as is,” and use is at the User’s own risk.
Intellectual Property
All intellectual property rights related to the Website belong to Pure Media or its licensors.
Users may not copy, distribute, or exploit any materials without permission.
Complaints
Complaints can be submitted via customer support or email.
Pure Media aims to respond within two business days.
Marketing Communications
Pure Media may use the User’s email address to send updates and offers.
Users may unsubscribe at any time.
Final Provisions
Pure Media may amend these terms at any time. Changes apply after 30 days’ notice.
These terms are governed by the laws applicable in the jurisdiction of Pure Media.
Parties agree to attempt to resolve disputes amicably before pursuing legal action.
